Edwin Jacobs bericht op zijn tweetalige weblog Law&Justice over de Deense versie van NVM-zoekallehuizen.nl: “in a groundbreaking judgment the Danish Maritime and Commercial Court accepted the use of deep linking in relation to real estate advertisement. The Court rules specifically on the realestate-broker vs. portals domain, allthough the wording of central paragraphs are very generic.

According to the Court, Ofir's deep linking is legal because it is done pursuant to principles of loyalty. The Court also mentiones that deep linking in general (so apparently not only in this real estate case) is a desirable function of the Internet and search engines. The Court also said that the www.home.dk real estate database is not considered as a database in the meaning of the database legislation (European Union Database-directive).

The Danish case could also be relevant for a very recent Dutch case where the Dutch association of real estate agents sued Zoekallehuizen.nl. (…) Both the Dutch and the Danish case are about real estate websites. I don't know all the facts, nor all the legal arguments used, but both of them are very relevant cases to follow because they are likely to have far-reaching consequences for other Internet businesses, and in particular, real estate websites and (meta) search engines.” Lees hier meer.
