"Dear friends and colleagues,
Today, 12 July 2011, the ECJ rendered its long awaited judgement in the L’Oréal v. eBay case and we will probably all be studying it over the next few days, weeks or months. The ECJ published a press release and there will probably some coverage in the popular press as well.
I would like to share my first impressions with you and I am curious to learn yours.
The case is, as you probably all know, about the liability of eBay for the sale by third parties of perfumes, which have not been brought on the market in the EU by the trademark owners, over eBay’s online auction platform, and the liability of eBay for the advertising through Google Adwords and otherwise for such sales.
In the course of trade
As far as I am concerned the first new and interesting bit can be found in par. 55:
“Accordingly, when an individual sells a product bearing a trade mark through an online marketplace and the transaction does not take place in the context of a commercial activity, the proprietor of the trademark cannot rely on his exclusive right as expressed in Article 5 of Directive 89/104 and Article 9 of Regulation No 40/94. If, however, owing to their volume, their frequency or other characteristics, the sales made on such a marketplace go beyond the realms of a private activity, the seller will be acting ‘in the course of trade’ within the meaning of those provisions”. "
