Dutch court overturns German court ruling

Nederlands nieuws via Minneapolis: “AGA Medical will appeal Dutch court’s ruling. A Dutch court ruled against AGA Medical Holdings Wednesday, finding that a competitor’s products do not infringe on the company’s patents. But AGA said Thursday it would appeal the decision.

AGA Medical, a Plymouth-based maker of devices for structural heart defects, sued Occlutech, a manufacturer of heart occlusion devices headquartered in Jena, Germany, for patent infringement in August 2006. The company claimed that Occlutech had infringed on one of its European patents for manufacturing intravascular occlusion devices.

A German court ruled in July 2007 that Occlutech had infringed on AGA Medical’s patents, but the patent court in The Hague, Netherlands, overturned that ruling.
