Modelaanvraag per fax niet geschikt voor registratie

Modellenrecht, registratie, fax, artikel 4(1)(e) CDIR*. Zound Industries heeft een verzoek gedaan tot het registreren van ontwerpen van (delen / verpakkingen van) een hoofdtelefoon (001290456; 1290464; 1290423; 1290431 en 1290415). Het verzoek tot registratie wordt ontvangen per fax. De gefaxte afbeelding van het model is van onvoldoende kwaliteit. Indien binnen een maand nadat het faxverzoek is gedaan een kopie van de aanvraag wordt nagezonden, geldt de datum van indiening van het per fax gedane verzoek.

In de richtlijnen voor onderzoek van Gemeenschapsmodellen staat dat een aanvraag per telefax (fax) niet geschikt is voor registratie. De afbeelding van het ontwerp kan door de aanvraag per fax mogelijk worden vervormd. Het besluit om de aanvraag niet te accepteren, wegens de slechte kwaliteit van de per fax verzonden ontwerp en het daardoor ontbreken van details, is juist. De kamer sluit zich aan bij het standpunt dat de details van het onderwerp waarvoor bescherming wordt gevraagd niet duidelijk zichtbaar zijn in de per fax verstuurde afbeelding. Het beroep wordt afgewezen.
16 The ‘Guidelines for the examination of Community designs’ available on the Office’s website oami.europa.eu state in paragraph 4.6.2 under the title ‘Transmission of the application by fax’ that ‘Transmission by telecopier (fax) may not be appropriate for design applications, because the representation of the design may be distorted. Where an application is transmitted by fax nevertheless, it is highly recommended that a confirmation copy is filed without delay, either by personal or post delivery’.

The question of whether the decision of the Office not to accept the representations of the design sent by fax as the quality of the reproduction is such that it does not permit all the details of the matter for which protection is sought to be clearly distinguished, was correct, has not been disputed by the applicant. In any case, the Board agrees with the examiner on this point, as the Board is also of the opinion that the details of the matter for which protection is sought in the case at hand can not be clearly distinguished from the representations sent by fax.
