OHIM 7 december 2012, ICD 000008383 (Burberry Ltd. tegen Miss Accessories S.R.L.; italiaans)

In't kort: Burberry Ltd roept succesvol haar oudere modellenrechtelijke bescherming van haar ontwerp in tegen een jonger Model (000252036-0004). Haar model is verschenen in het Community Design Bulletin, dat is voldoende bewijs dat het ontsloten was ex 7(1) GModVo.

De modellen zijn niet identiek, maar visueel en conceptueel erg gelijkend. De verschillen zitten slechts in het gebruik van de kleuren roodbruin, beigekleurig bruin en bruin. Het litigieuze model vertoond ook meer verticale en horizontale lijnen dan het ouder model.

De registraties overlappen ten minste met één van de klassen. Het jonger model wordt nietig verklaard, omdat het niet voldoet aan 25(1)(e): Een Gemeenschapsmodel kan slechts in de volgende gevallen nietig worden verklaard; (e) in een later model wordt van een onderscheidend teken gebruik gemaakt en het Gemeenschapsrecht of het recht van de lidstaat dat op dat teken van toepassing is, staat de houder van het recht op het teken toe dat gebruik te verbieden;

(9) D1 is a Community trade marks published in the Bulletin Community for the first time on 13 July 1998. Therefore, the publication is sufficient evidence that D1 was disclosed under Article 7 (1) DRC.

(20) The signs are not identical, but they are very similar from a visually and conceptually point of view. In fact, both signs represent a fabric, in which the greater difference is represented by the use of a shades of reddish brown in the DMC disputed and of a beige color brownish, or brown, in the CTM. Another difference is represented by the vertical and horizontal lines, which are more numerous in the contested DMC.

(21) The DMC is registered for "scarves". The earlier Community was recorded for "leather and imitations of goods made of these materials not included in other classes, animal skins, trunks and suitcases, umbrellas,
parasols and walking sticks, whips and saddlery "in Class 18 of the International Classification of Nice, for "fabrics and textile goods, not included in other classes, bed and table covers "in Class 24 of the International Classification of Nice and "clothing, footwear, headgear" in Class 25 the International Classification of Nice. It can be concluded that products for which the mark is used in the DMC content are included in products of at least one of the classes for which is recorded the earlier Community trade mark, or the articles of clothing in Class 25.

(24) The contested Community design shall be declared void because does not meet the requirements of Article 25, paragraph 1, letter e), DRC. It is therefore necessary to examine the other grounds for invalidity indicated by the applicant, or the lack of novelty and character individual, pursuant to Article 25, paragraph 1, letter b).
