The Roundtable will focus on the question of whether trademark law still has a role to play in cases of comparative advertising. Does the Directive actually cover Harmonised EU Trademark Law? Will all instances of comparative advertising under the Directive's definition be put to the Directive's test of 'not being misleading and containing an objective comparison of material and relevant features of goods/services that are intended for the same purpose, which comparison does not take unfair advantage of another's trademark nor create confusion,' etc? What opportunities does Benelux law offer outside the Harmonized part of Trademark law? Come and join the discussion! A complimentary cocktail will follow at the end of the debate."
