Het Commissariaat voor de Media heeft vandaag bepaald dat het Talpa niet kan dwingen een sublicentie te geven aan de NOS voor het uitzenden van beknopte beelden van voetbalwedstrijden van de Eredivisie. De NOS had om een uitspraak van het Commissariaat gevraagd op basis van het voorkeursrecht in de Mediawet.

Volgens commissaris Inge Brakman is het artikel (71t Mediawet) waarop de NOS zich beroept, oorspronkelijk bedoeld om ervoor te zorgen dat belangrijke evenementen, waaronder voetbalwedstrijden, niet achter de decoder verdwijnen en te ontvangen zijn door nagenoeg het hele Nederlandse publiek: “Daar wordt nu door de uitzendingen van Talpa en RTL4 aan voldaan. Wat de IE-invalshoek is, is onbetaald niet duidelijk, maar het zal ongetwijfeld iets met auteursrecht of merkenrecht te maken hebben: Uitgeverij L.J. Afgelopen vrijdag is in de minsterraad, naar aanleiding van de instemming met de voortgangsrapportage terrorismebestrijding van minister Donner van Justitie en minister Remkes van Binnenlandse zaken en Koninkrijksrelaties, besloten tot instelling van een meldpunt Computercriminaliteit. Volgens de voortgangsrapportage terrorismebestrijding "is de terrorismedreiging op onderdelen veranderd maar is deze nog steeds 'substantieel'. Hoewel er de afgelopen maanden geen sprake is geweest van een terroristisch incident tegen Nederland moet hiermee nog steeds rekening worden gehouden."

Campina ziet af van het kort geding tegen Friesland Foods (zie eerder bericht). Partijen zouden hebben afgesproken dat Friesland Foods in de campagne zal zeggen dat het alleen om een vernieuwing gaat.
